OPVIUS GmbH has lodged an appeal against Patent DE 10 2010 029 739 B4 “Solar plant with multiple power-generating film elements”, registered by Solartension GmbH in 2010 and issued in 2015. The first instance of the recently initiated appeal proceedings before the German Patent and Trademark Office (DPMA) in Munich has seen the DPMA agree with OPVIUS GmbH’s view. Following a hearing on 14/11/2018, the DPMA revoked the patent for lack of protectability in view of the technological standards cited by OPVIUS GmbH. The DPMA’s decision does not yet have legal effect and cannot yet be appealed.
Dr Ralph Pätzold, CEO of OPVIUS GmbH, had this to say: “OPVIUS GmbH is willing to assert its own proprietary rights and interests at all times. If necessary, as in this case, we are also prepared to represent our interests over the long term by challenging third-party patents in order to protect our developments and the associated market access.”
